Caravan — iOS and Android Application

These Terms of Service govern your use of Caravan, an iOS and Android application developed and published by Ojee Labs. By creating an account or using the app, you agree to these terms. Please read them carefully. If you do not agree, do not use the app.

Acceptance of Terms

By accessing or using Caravan, you confirm that you agree to be bound by these Terms of Service and our Privacy Policy, and that you are at least 13 years old, or that a parent or guardian has reviewed and agreed to them on your behalf.

Ojee Labs reserves the right to update these terms at any time. The effective date at the top of this page will reflect the most recent revision. Continued use of the app after changes are posted constitutes acceptance of the revised terms.

Your Account

You need an account to use Caravan. You can sign up with an email address and password, or with Google or Apple. You are responsible for keeping your sign-in details secure and for activity on your account. Please give a name your fellow travelers will recognize, and don't impersonate anyone else.

You can delete your account at any time in Settings. What happens to your data when you do is described in the Privacy Policy.

License to Use

Ojee Labs grants you a personal, non-exclusive, non-transferable, revocable license to use Caravan on any device you own or control, subject to these terms and the terms of the app store you downloaded it from.

Trips, Organizers and Members

Each trip (a “Caravan”) has one or more organizers. Organizers can invite and remove members, manage the itinerary, make other members organizers, end the trip, and delete members' content or the trip itself. By joining a trip, you agree that its organizers can do these things.

Only join trips with people you know and trust. Ojee Labs does not check who is invited to a trip, and is not responsible for the conduct of the people you travel or share with.

Location Sharing

Location sharing is optional and off until you turn it on for a trip. When it is on, the trip's members can see where you are while the trip is in progress. Share your location only with people you are comfortable with, and turn it off whenever you like.

Locations, distances, directions, meeting-point alarms and map data may be delayed, approximate, or unavailable, for example when you have no signal or have turned off background location. Do not rely on Caravan for safety, emergencies, or navigation where accuracy matters. In an emergency, contact local emergency services.

Your Content

You keep ownership of the photos, messages, comments and other content you add to Caravan (“your content”). You grant Ojee Labs a worldwide, non-exclusive, royalty-free license to store, copy, display and transmit your content solely to operate Caravan and show it to the members of the trip you added it to, including after you leave the trip or delete your account, as described in the Privacy Policy.

Trip members can view, download and share content added to their trip, including full-quality original photos. Only add content you are happy for the trip's members to keep.

You are responsible for your content, and you confirm you have the right to share it. You must not use Caravan to post or share content that:

To report content or a user, contact us at support@ojeelabs.com. We may remove content and suspend accounts that violate these terms.

Notifications

If you allow notifications, Caravan sends trip notifications such as invitations, meeting-point alarms, new messages, comments and reactions. You can turn them off for one trip, for your whole account in Settings, or in your phone's settings. Notifications may be delayed or not delivered, so don't rely on them alone for time-sensitive plans.

Price

Caravan is free to download and use. If we offer paid features in the future, their price and terms will be shown in the app before you buy, and purchases will be processed by Apple or Google.

Intellectual Property

The app, including its design, graphics, code, and the Caravan and Ojee Labs names and logos, is the exclusive property of Ojee Labs or its licensors and is protected by applicable intellectual property laws. Map data belongs to its providers. Nothing in these terms grants you any right to use the Ojee Labs or Caravan names, logos, or any other proprietary material without our prior written consent.

Disclaimers

Caravan is provided “as is” and “as available” without warranties of any kind, either express or implied. Ojee Labs does not warrant that the app, its notifications, or its location features will be accurate, uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by law, Ojee Labs disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by applicable law, Ojee Labs and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app, including missed meetings or plans, loss of data or content, or the acts of other users.

In no event shall Ojee Labs’ total liability to you for all claims arising from or relating to these terms or your use of the app exceed the greater of the amount you paid us in the twelve months preceding the claim and US$50.

Termination

Ojee Labs reserves the right to terminate or suspend your access to the app at any time, with or without cause, if we believe you have violated these terms or applicable law. Upon termination, your license to use the app is revoked.

You may stop using the app at any time by deleting your account in Settings and removing the app from your device.

Governing Law & Disputes

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising from these terms or your use of the app shall first be attempted to be resolved informally by contacting us at support@ojeelabs.com. If informal resolution is unsuccessful, disputes shall be resolved by binding arbitration in California, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

Apple App Store

If you downloaded Caravan from the App Store, these terms are between you and Ojee Labs only, not with Apple. Apple is not responsible for the app or its content. In the event of any conflict between these terms and Apple's Licensed Application End User License Agreement, Apple's terms shall govern.

Apple has no obligation to provide maintenance or support services for Caravan. Apple is a third-party beneficiary of these terms and may enforce them against you.

Google Play

If you downloaded Caravan from Google Play, these terms are between you and Ojee Labs only, not with Google. Your use of Google Play is also subject to the Google Play Terms of Service. Google is not responsible for the app or its content.
